1. Acceptance of Terms

By downloading, installing, or using ColorBlend ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and ColorBlend ("we," "us," or "our").

2. Description of Service

ColorBlend is a mobile puzzle game that challenges players to mix colors to match target colors. The App includes:

• Multiple challenge packs with varying difficulty levels
• Daily challenges
• Power-ups that can be purchased with in-game gems
• Optional in-app purchases for ad-free experience and pack bundles
• Integration with Apple Game Center for leaderboards

3. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use ColorBlend for personal, non-commercial purposes, subject to these Terms.

You may NOT:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its systems
• Use automated tools or bots to interact with the App

4. User Accounts and Game Data

4.1 Account Responsibility

You are responsible for maintaining the security of your device and any data stored within the App.

4.2 Data Backup

Game progress is stored locally on your device. We recommend backing up your device regularly. We are not responsible for loss of game progress due to device failure, app deletion, or device changes.

4.3 Game Center

If you use Apple Game Center features, you must comply with Apple's Game Center Terms of Service.

5. In-App Purchases

5.1 Purchase Terms

The App offers in-app purchases including:

• Ad-Free upgrade (one-time purchase)
• Pack bundles (one-time purchases)

All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.

5.2 Pricing

Prices are displayed in your local currency and may vary by region. Prices are subject to change without notice.

5.3 Refund Policy

All sales are final. Refund requests must be submitted through the Apple App Store according to Apple's refund policies.

5.4 Virtual Currency

Gems are the virtual currency in ColorBlend. Gems have no real-world value and cannot be exchanged for cash. Gems earned or purchased are non-refundable and non-transferable.

6. Advertising

The free version of ColorBlend displays advertisements through Google AdMob. By using the free version, you agree to view advertisements.

You can remove ads by purchasing the Ad-Free upgrade.

We are not responsible for the content of third-party advertisements.

7. Intellectual Property

All content in ColorBlend, including but not limited to:

• Graphics, designs, and user interface
• Game mechanics and algorithms
• Color palettes and puzzle designs
• Text, audio, and visual content
• Trademarks, logos, and branding

...are owned by ColorBlend or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not use our intellectual property without our prior written consent.

8. User Conduct

You agree not to:

• Use cheats, exploits, or automation tools
• Manipulate leaderboards or game scores
• Interfere with other players' enjoyment of the App
• Use the App to harass, abuse, or harm others
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate access for violations of these conduct rules.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DO NOT WARRANT THAT:

• The App will be uninterrupted, secure, or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• Results from using the App will be accurate or reliable

Your use of the App is at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or use
• Loss of game progress or virtual items
• Any damages arising from use or inability to use the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR IN-APP PURCHASES IN THE PAST 12 MONTHS, OR $10, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless ColorBlend, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through the App

12. Updates and Modifications

12.1 App Updates

We may release updates, patches, or new versions of the App. Updates may be required to continue using the App.

12.2 Feature Changes

We reserve the right to modify, suspend, or discontinue any feature of the App at any time without notice.

12.3 Terms Updates

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent activity
• Abuse of the App or other users
• Any other reason at our sole discretion

Upon termination, your right to use the App will cease immediately. You may delete the App from your device at any time.

14. Third-Party Services

The App integrates with third-party services:

• Apple App Store: Subject to Apple's Terms of Service
• Apple Game Center: Subject to Apple's Game Center Terms
• Google AdMob: Subject to Google's Terms of Service

We are not responsible for third-party services or their terms and policies.

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or the App shall be resolved through binding arbitration, except you may assert claims in small claims court if they qualify.

15.3 Class Action Waiver

You agree that disputes will be resolved individually, not as part of a class action or consolidated proceeding.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ColorBlend.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms. We may assign these Terms without restriction.
